We at Texas Legal Shop need to know basic information about:
Your spouse,
Your children (if any),
Visitation pickup times,
Child support,
Any car payments,
Insurance payments
If there are children, we at Texas Legal Shop need to know who the children will be living with(the "custodial parent").
Custodial Parent
At Temporary Order’s hearings with children the big fight is over who the primary care giver parent of the child(ren) is and is that care very good. Courts generally give a good primary care giver parent Temporary custody of the child(ren). We need to know who the child(ren) will live with and the address.
Visitation
Due to political activism, the rights of the parent, who the children do not live with(the "non-custodial parent"), has expanded slightly in recent years.
Therefore, the mid-week Wednesday 2 hr visitation has expanded to a Thursday overnight visitation during the school term. (This is only for a non-custodial parent who can get the child(ren) to school.) We need to know if the non-custodial parent can take the child(ren) to school on Fridays.
Also, for non-custodial parents who can pickup or arrange the pickup of the child(ren) at school; visitation can start at the end of school, at 6:30 pm or another time at the "home" of the child(ren) or any other location.(Some of our clients chose a local police station, restaurant, or park.)
We need to know the location and time of visitation beginning.
Residential matters
If there are children:
At a Temporary Orders hearing, to lessen the psychological impact of divorcing parents on the children, most courts will attempt to allow the custodial parent to continue to live in the residence with the children.
We need to know for Agreed Temporary Orders where the custodial parent will be living.
Child Support
Child support must only be paid on ones biological or adopted children. A person does not have to pay child support on step-children, unless they were adopted. State law mandates the percentage based off the number of children in the marriage and the other number of children(less than eighteen) the one who will be paying child support has.
Therefore, we need to know the...
1) name of the person paying child support;
2) the number of children in this marriage; and
3) the number of other children the one paying child support has, who are less
than eighteen years of age.
Health Insurance
As a part of child support, health insurance on the children is required. We need to know how much it is, who will be providing it and which company is it through.
Protecting Community(Marital) funds
Who drives which vehicle during the divorce? We need to know who drives which vehicle:
1) Its make;
2) Model;
3) Year; and
4) VIN or license number.
Who is responsible for any car payments? We need to know:
1) Who is to pay the car note;
2) The name of the company;
3) The amount of the car payment,
4) Account number; and
5) When paid by date(day of the month).
Who is to pay for any car insurance? We need to know:
1) Who is to pay the car insurance;
2) The insurance company;
3) The amount;
4) Account number; and
5) When paid by date(day of the month).
If the is a mortgage or rent payment on the residence, who is responsible to pay it. We need to know:
1) Who is responsible to pay the mortgage/rent;
2) The name of the company;
3) Amount to pay;
4) Account number(if a mortgage); and
5) When paid by date(day of the month).
Who is to pay for any home insurance? We need to know:
1) Who is to pay the home insurance;
2) The insurance company;
3) The amount;
4) Account number; and
5) When paid by date(day of the month).
